Child Visitation Rights
Do you need the other parent’s permission if you want your child to visit a family member? I’m Mayes County lawyer, Lindsay McDowell, and I’m here to discuss that issue with you today.
The first question you need to ask yourself is, what does your court order say about what other family members your child can visit? If there are no limitations in your court order saying that your child cannot visit certain family members, then generally, the parent has the right to make that decision without seeking permission from the other parent.
Now, it is important to make sure that your order is clear on this, but if there are no limitations, then you should be able to take your child to visit another family member. You also, though, need to determine whether or not the court order would allow overnight visitation or would allow you to take the child and drop them off with someone without the other parent’s permission. These are all things that you need to review in your court order first to make sure that there are no limitations on what you can do.
